बहुजन लोकपाल बिल / Bahujan Lokpal Bill

We  want to submit some suggestion regarding the Government’s Lokpal Bill. Like Anna’s Lokpal Bill our Lokpal Bill named as “Bahujan Lokpal Bill” should also put on parliament and should be discussed it in same way as other Bill.

 We are demanding that following provision should be taken into consideration when making of the Government’s Bill:

1. Like Public Sector Company (PSU) private company, NGO, Media group should bring under the perview of Article 12 of constitution as 'other authority' and bring them under the perview/jurisdiction of Lokpal.

पब्लिक कम्पनी के समान प्राइवेट कम्पनी, एन. जी. ओ., मीडिया समूह को संविधान के अनुच्छेद १२ के अंतर्गत "अन्य अधिकारी" के परिभाषा के दायरे मे लाते हुए उन्हें भी लोकपाल माना जाय तथा लोकपाल अधिनियम के दायरे मे लानी चाहिए

2. Religious Trust, Math, Mandir, Waqf Board, church, Gurudwara like religious entity should also bring undar the perview of Lokpal Bill or there should be religious Property Acoountibility Bill like Judicial Accountibility Bill.

धार्मिक ट्रस्ट, मठ, मंदिर, वफ्फ़ बोर्ड गुरूद्वारे, चर्च इत्यादी धार्मिक संगठनों को भी इसके दायरे मे लाया जाय या Judiciary Accountability Bill के समान Religious Property Accountability Bill लाया जाय |

3. There should be representation of all community in lokpal sellection committee.

लोकपाल चयन समिति मे सभी समुदाय (OBC/SC/ST/Minority/Female) का प्रतिनिधित्व होना चाहिए/

4. The selection of Lokpal should be in joint setting of parliament and there should be discuss regarding his qualification, conduct character and reputation in public.

लोकपाल का चयन संसद के दोनों सदनों की संयुक्त बैठक में किया जाए और उसके योग्यता, आचरण, चरित्र और जनसामान्य में उसकी छबि पर विस्तार से चर्चा हो/

5. There should be representation of all community in member (Lokayukt) of Central/State's Lokpal Act.  लोकपाल (OBC/SC/ST/Minority/Female) मे भी सभी समुदाय के सदस्य होनी चाहिए

6. The minimum number of Lokpal should be not less than 14 and this office should comes under the perview of Reservation so that all community should be represented.

लोकपाल की संख्या कम से कम 14 होगी और यह पद भी आरक्षण के दायरे में होगा जिससे समाज के सभी वर्गों का प्रतिनिधित्व हो

7. The Head of Lokayukt should be on rotational Basis so that every social group should represent.

 मुख्य लोकपाल का पद रोटेशन से चारों संविधान सम्मत सामाजिक समूहों के पास बारी-बारी से जाएगा।

8. The office of Head should not be more than 2 years.

लोकायुक्त का प्रमुख के पद की समय सीमा २ वर्ष से ज्यादा नहीं होने चाहिए 

9. If it is proved that the membar of lokpal (Lokpal) is a political Biased he/she should be suspended immediately. But for removal the process should be similar as Justice of HC/SC

यदि यह सिद्ध हो जाता है कि लोयायुक्त या अन्य सदस्य राजनितिक हो तो उसे तुरंत निलंबित करना चाहिए.

परन्तु लोकपाल को हटाने की वही प्रक्रिया हो जो उच्च या उच्चतम न्यायालय के न्यायधीश को हटाने की होती है।

10. The power/office of Lokayukt is equal to the power of High Court.

लोकायुक्त का पद और शक्तिया उच्च न्यायालय के न्यायधीश के बराबर होनी चाहिए

11. The violation of or not execute the provision of reservation and social justice should be treated as corruption and for this the punishment should be same as for corruption in economic sense.

आरक्षण और सामाजिक न्याय के प्रावधानों का उल्लंघन भ्रष्टाचार माना जाए और इस अपराध के लिए भी वही दंड विधान हो जो भ्रष्टाचार के लिए है/

12. The misuse of SC/ST/OBC fund should be treated as corruption and for this the punishment should be same.

एससी-एसटी-ओबीसी फंड का दुरुपयोग भ्रष्टाचार माना जाए और और इस अपराध के लिए भी वही दंड विधान हो जो भ्रष्टाचार के लिए है। 

13.  The definition of Corruption should be expended and money taken through cheating or fraud from illiterate and on the name of faith should also be treated as Corruption.

भ्रष्टाचार की  का विस्तार हो. जैसे - अंधविश्वास और आस्था के नाम पर अशिक्षित और अजागरुक लोगों से पैसे की ठगी भी भ्रष्टाचार है. 

14. The activity and conduct of M.P. and M.L.A. in parliament should not come under the jurisdiction of Lokpal.

लोकपाल सांसदों और विधायकों के सदन के अंदर किए गए आचरण की जांच न करे।

15. The office and officer of Lokpal should come under the jurisdiction of Right to Information Act.

लोकपाल का दफ्तर और इसके सभी पदाधिकारी सूचना का अधिकार कानून के दायरे में होंगे 

16. The Lokpal and Lokayukt should be united through a Bill but there should be equal respect for federal structure लोकपाल और लोकायुक्त को एक बिल के द्वारा संगठित किया जा सकता है लेकिन इसमें संघीय भावना का पूर्ण सम्मान हो.

17. If there is conflict/contradiction between the provision of Constitution of India and Lokpal, the provision of Constitution of India will prevail. 

यदि भारत के संविधान और लोकपाल के प्रावधानों में टकराव या विभेद होता है तो भारत के संविधान का प्रावधान को बरियता दी जायेगी /

18. The lokpal should be bound to give the information of his and his family property and there should be an adit of his property till after 10 years of end of his office.

लोकपाल और उसके परिवार के सारे सदस्यो को(बीबी, बच्चे, भाई, बहन) अपनी सम्पत्ती का विवरण राष्ट्र को देना चाहीए और हर साल उसका ऑडिट होना चाहिए। लोकपाल के कार्यकाल के समाप्ती के बाद दस साल तक उसकी सम्पत्ती का ऑडिट होना चाहिए.
